Ignorance of producer responsibility laws is no defence!

It has long been held that ignorance of the law is not a defence (ignorantia juris non excusat) and a Middlesex company recently had this costly lesson confirmed in the courts.

Babz Media Ltd were recently prosecuted for offences under three Producer Responsibility regimes (Packaging, WEEE and Batteries) and, despite not having be aware of the regulations before they were contacted by enforcement officers from the Environment Agency, were found guilty by Ealing Magistrates Court – on 6 August 2015 – and fined £45,500 with an additional £8,724.98 in costs and avoided registration fees accrued over a two year period.

Failing to register as a producer and, where appropriate, to join a compliance scheme to ensure that the costs of dealing with waste packaging, electrical or electronic equipment, and batteries have been met has been an expensive oversight for this company.

Don’t let this happen to you. If you want to be sure that you are meeting all your legal obligations in respect of environmental laws, call us. Our initial discussion costs you only the phone call and we can give you no obligation advice on what you may need to consider in more detail. Our full compliance audit will give you complete peace of mind and can, as the Babz Media case shows, save you a lot of money, stress and reputational damage.
